Terms and Conditions for epost
By signing up for electronic billing, you agree to the following terms and conditions by Direct Energy Marketing Limited.
In opting to receive your statement electronically you allow Direct Energy Marketing Limited ("DEML") to provide your statement images and necessary information (including personal information) related thereto to the epost™ service for the purpose of allowing you to view these images.
You agree and understand that it is your
responsibility to visit your epost™ box to receive your statement
electronically. Failure to visit your epost™ box or technical
difficulties with the epost™ web site will not obviate you of your
payment obligations. Your use of the epost™ website
is at your sole risk. To the fullest extent permissible pursuant to
applicable law, DEML disclaims all warranties, expressed or implied,
including, but not limited to, implied warranties of accuracy,
merchantability and fitness for a particular purpose. Without limiting
the generality of the foregoing, DEML shall have no responsibility or
liability for any damages caused to computer systems, software or
electronic files by computer viruses, "worms", "trojan horses" or other
items or forces of an intrusive, disruptive or destructive nature which
may relate to your use of the epost™ site.
DEML will not be
responsible or liable for any delay,damage, loss or inconvenience you
or any other person may incur in the event of unauthorized access to
your epost™ box or your personal information.
DEML will not be responsible or liable for any delay, damage, loss or
inconvenience you or any other person may incur if you are unable to
access the epost™ website, do not receive your mailpieces, or
experience any delay in the processing of any transaction for any
reason whatsoever. WITHOUT LIMITING ANY OF THE FOREGOING, AND
NOTWITHSTANDING ANYTHING ELSE IN THESE TERMS AND CONDITIONS, OR ANY
OTHER COMMUNICATION OR DOCUMENT, DEML WILL NOT BE RESPONSIBLE FOR ANY
DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OR ANY
OTHER DAMAGES WHATSOEVER, EVEN IF DEML IS EXPRESSLY ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES, ARISING OUT OF OR IN CONNECTION WITH THE
SERVICE, COMMUNICATIONS TO AND FROM YOU AND CANADA POST PARTIES (EVEN
IF SUCH COMMUNICATIONS RELATE TO DEML) , OR ANY SOFTWARE, INFORMATION
OR DOCUMENTS CONTAINED IN OR ACCESSED VIA THE SERVICE, INCLUDING
WITHOUT LIMITATION ANY LOSS OF USE, LOST DATA, LOST BUSINESS PROFITS,
BUSINESS INTERRUPTION, PROPERTY DAMAGE, PERSONAL INJURY OR ANY OTHER
LOSS, WHETHER THE ACTION IS IN CONTRACT, TORT (INCLUDING WITHOUT
LIMITATION NEGLIGENCE) OR OTHERWISE.
DEML may update these terms and conditions from time to time without notice to you. You are responsible for apprising yourself of the updated terms and conditions and adhering to them.
